The Charter of the City of Hia leah states th at contracts in amounts greater tha n $25,000 .00 shall be awa rded on the basis of
specifications and formal sealed bids. The council may award a contract to the lowest responsible and responsive bidder, or it
may reject all bids and re -advertise ; or it may waive competitive bidding w hen it finds it to be in the best in terest of the City.
The City of Hialeah published 1TB No . 2022-236-3110-12-009 (Right-of-Way Turf & Landscape Maintenance -Sector 6 ) to
establish two contracts , a primary and a secondary, securing the services of contractors with the ability to supply all labor,
equipment and materials to maintain designated right-of-ways and properties within the city . A total of four resp o nses were
received . The Rig ht-of-Way Turf & Landscape Maintenance Contract Selection Committee reviewed the responses and
ranked the responsive and responsible bidders based on (a) price, (b) qualifications, experience , manpower and equipment,
and (c) con t ractor's approach to scope of work . Upon completion of the review and ranking , the selection committee
recommended Visual Scape , Inc. for the primary contract and Super Landscape & Maintenance, Inc. for the secondary
contract.
The se lection committee 's recommendation was upheld in Fi scal Year 2023 and Visual Scape, Inc. and Supe r Landscape &
Maintenance, Inc. were awarded the primary and secondary contracts , respectively, of the Right-of-Way Turf & Landscape
Maintenance Sector 6 services with the option to renew the agreements for four consecutive one -year tenms. The Fiscal Year
2023 agreements expired on September 30 , 2023 howeve r, the vendors have agreed to renew the contract for an additional
one-year term ending on September 30 th , 2024 . I am therefore respectfully requ esting your approval to renew the Right-of-
Way Turf & Landscape Maintenance Sector 6 primary agreemen t with VisualScape Inc. in an amount not to exceed
$18,480.00 for mai ntenance services up to September 30th , 2024. I am further reques ting approva l to renew the secondary
agreement, as backu p to primary agreement, with Super Landscape & Maintenance, Inc. in an amount to exceed $16,511 .00
for maintenance services up to September 30th, 2024 .
Funding for this expenditure wil l be drawn against ROW Ma intenance -Sector 6 Account 101.3210.541467-6.

RESOLUTION NO. -----
RESOLUTION OF THE MAYOR AND THE CITY COUNCIL OF
THE CITY OF HIALEAH, FLORIDA APPROVING THE
RENEWAL OF A RIGHT-OF-WAY TURF AND LANDSCAPE
MAINTENANCE AGREEMENT FOR SECTOR 6 WITHIN THE
CORPORATE LIMITS OF THE CITY OF HIALEAH, FOR A
TERM OF ONE YEAR, COMMENCING ON OCTOBER 1, 2023
AND ENDING ON SEPTEMBER 30, 2024, IN AMOUNTS AS
SPECIFIED HEREIN WITH VISUALSCAPE, INC. AND SUPER
LANDSCAPE & MAINTENANCE, INC.; AUTHORIZING THE
MAYOR AND THE CITY CLERK, AS ATTESTING WITNESS,
ON BEHALF OF THE CITY, TO EXECUTE THE CONTRACT
RENEWAL AND ALL OTHER CUSTOMARY AND
NECESSARY DOCUMENTS TO CARRY OUT THIS
RESOLUTION; AND PROVIDING FORAN EFFECTIVE DATE.
WHEREAS, the City of Hialeah ("City") published an Invitation to Bid (1TB) No. 2022-
23-3110-12-009 for Right-of-Way Turf and Landscape Maintenance -Sector 6 within the
corporate limits of the City of Hialeah which sought the services of contractors with the ability to
supply all labor, equipment, and materials to maintain these areas within the City; and
WHEREAS, the City sought two Turf and Landscape Maintenance Agreements by which
there were primary and secondary Agreements; and,
WHEREAS, both the above-named contractors were recommended by the Right-of-Way
Turf and Landscape Maintenance Contract Selection Committee and were awarded Agreements
by the City Council, of which all Agreements expired on September 30, 2023; nevertheless, the
above-named contractors have agreed to renew their Agreements for an additional one-year term
expiring on September 30, 2024; and
WHEREAS, the parties wish to renew their agreement for an additional year subject to
the same terms and conditions; and
WHEREAS, the parties are authorized to enter into these Renewal Agreements pursuant
to applicable laws and regulations; and
WHEREAS, both of the above-named contractors are incorporated business entities in good
standing with the State of Florida; and
WHEREAS, it is in the best interest of the health, safety, and welfare of the City of Hialeah
to renew these Turf and Landscape Maintenance Agreements to ensure the safety of the residents
of the City as well as to improve the aesthetic value of the community.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY
COUNCIL OF THE CITY OF HIALEAH, FLORIDA, THAT:
Section 1: The foregoing facts and recitations contained in the preamble to this
resolution are hereby adopted and incorporated by reference as if fully set forth herein.

Section 2: The City of Hialeah, Florida hereby approves the renewal of the Turf and
Landscape Maintenance Agreement-Sector 6 with the primary Agreement with VisualScape, Inc.
in an amount not to exceed $18,480.00 and the secondary Agreement with Super Landscape &
Maintenance, Inc. in an amount not to exceed $16,511.00 respectively, for the maintenance of turf
and landscape on designated roads within the corporate limits of the City of Hialeah, for an
additional one-year term, commencing on October 1, 2023 and ending on September 30, 2024, in
an amount as specified herein. Funding for this expenditure is to be drawn against Right-of-Way
(ROW) Account 101.3210.541467-6.
Section 3: The Mayor and the City Clerk, as attesting witness, are hereby authorized
to execute, on behalf of the City, the Renewal Agreement, and/or all other customary and necessary
documents to carry out this resolution. The Mayor is additionally authorized to administratively
renew these Agreements, as provided for by the Agreements, provided that available funding is
allocated and approved and that the Contractors honor the renewal terms. All actions taken to date
by officers of the City in furtherance of the performance of this agreement are hereby approved,
confirmed, and ratified.
Section 4: This resolution shall become effective when approved by a majority vote of
the City Council and signed by the Mayor or at the next regularly scheduled City Council meeting,
if the Mayor's signature is withheld or if the City Council overrides the Mayor's veto.
