Dear Mayor and Counci l Members:
The Charter of the City of Hialeah states that contracts in amounts greate r than $25 ,000.00 shall be awarded on the basis of
specifications and formal sealed bids. Th e council may award a contract to the lowest res ponsible and responsive bidder , or it
may reject all bids and re-advertise; or it may waive competitive bid ding when it finds it to be in the best interes t of the City .
The City of Hialeah published 1TB No . 2022 -2 36-3110-12-005 (Right-of-Way Turf & Landscape Maintenance -Sector 2) to
establish two contracts , a primary and a secondary , securing the services o f contractors with the ability to supply al l labo r,
equipment and materials to maintain designated right-of-ways and properties within the city. A total of four responses were
rece ived . Th e Ri ght-of-Way Tu rf & Landscape Maintenance Contract Selection Comm ittee reviewed the responses and
ranked the responsive and responsible bidders based on (a) price, (b) qua lifications , experience, manpower and eq uipment,
and (c) contractor's approach to scope of work. Upon completion of the review and ranking , the selection committee
recommended Visual Scape , Inc. for the primary con tract and Super Landscape & Mai ntenance , Inc. fo r the secondary
contract.
The se lection committee 's recommendation was upheld in Fisca l Year 2023 and Visual Scape, Inc. and Super Landscape &
Maintenance , Inc. were awa rded the primary and secondary contracts , respective ly, of the Rig ht-of-Way Tu rf & Landscape
Maintenance Sector 2 services w ith the option to renew the agreements for four consecutive one-year terms. The Fiscal Yea r
2023 agreements expired on September 30, 2023 however, the vendors have agreed to renew the contract for an additional
one-year term ending on September 30111, 2024 . I am therefore respectfully requesting you r approval to renew the Right-of-
Way Turf & Landscape Maintenance Sector 2 primary agreement with VisualScape Inc. in an amount not to exceed
$188,188.00 for maintenance services up to September 30th , 2024. I am further requesting ap prova l to renew the secondary
agreement, as backup to primary agreement, with Su per Landscape & Maintenance, Inc. in an amount to exceed $160 ,622.00
for maintenance services up to September 30 th, 2024 .
Fund ing for this expenditure will be drawn against ROW Maintenance -Sector 2 Acco unt 101.3210.54 1467-2 .
VisualScape , Inc. and Super Landscape & Maintenance, Inc. are both active corporation in good standing in the State of
Florida.

RESOLUTION OF THE MAYOR AND THE CITY COUNCIL OF
THE CITY OF HIALEAH, FLORIDA APPROVING THE
RENEWAL OF A RIGHT-OF-WAY TURF AND LANDSCAPE
MAINTENANCE AGREEMENT FOR SECTOR 2 WITHIN THE
CORPORATE LIMITS OF THE CITY OF HIALEAH, FOR A
TERM OF ONE YEAR, COMMENCING ON OCTOBER I, 2023
AND ENDING ON SEPTEMBER 30, 2024, IN AMOUNTS AS
SPECIFIED HEREIN WITH VISUALSCAPE, INC. AND SUPER
LANDSCAPE & MAINTENANCE, INC.; AUTHORIZING THE
MAYOR AND THE CITY CLERI(, AS ATTESTING WITNESS,
ON BEHALF OF THE CITY, TO EXECUTE THE CONTRACT
RENEWAL AND ALL OTHER CUSTOMARY AND
NECESSARY DOCUMENTS TO CARRY OUT THIS
RESOLUTION; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Hialeah ("City") published an Invitation to Bid (1TB) No. 2022-
236-3110-12-005 for Right-of-Way Turf and Landscape Maintenance -Sector 2 within the
corporate limits of the City of Hialeah which sought the services of contractors with the ability to
supply all labor, equipment, and materials to maintain these areas within the City; and
WHEREAS, the City sought two Turf and Landscape Maintenance Agreements by which
there were primary and secondary Agreements; and
WHEREAS, both the above-named contractors were recommended by the Right-of-Way
Turf and Landscape Maintenance Contract Selection Committee and were awarded Agreements
by the City Council, of which all Agreements expired on September 30, 2023; nevertheless, the
above-named contractors have agreed to renew their Agreements for an additional one-year term
expiring on September 30, 2024; and
WHEREAS, the parties wish to renew their agreement for an additional year subject to
the same terms and conditions; and
WHEREAS, the parties are authorized to enter into these Renewal Agreements pursuant
to applicable laws and regulations; and
WHEREAS, both of the above-named contractors are incorporated business entities in good
standing with the State of Florida; and
WHEREAS, it is in the best interest of the health, safety, and welfare of the City of Hialeah
to renew these Turf and Landscape Maintenance Agreements to ensure the safety of the residents
of the City as well as to improve the aesthetic value of the community.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY
COUNCIL OF THE CITY OF HIALEAH, FLORIDA, THAT:

The City of Hialeah, Florida hereby approves the re newal of the Turf and
Landscape Maintenance Agreement-S ector 2 with the primary Agreement w ith V isualS cape, Inc.
in an amount not to exceed $188 ,18 8.00, and th e second ary Agreement with Super Landscape &
Maintenance, Inc. in an amount not to exceed $160,622.00 respectively, for the maintenance of
turf and landscape on designated road s within the corporate limits of the City of Hialeah, for an
a dditiona l one-year term, commenc ing on October 1, 2023 and ending on September 30, 2024, in
an amount as specified her e in. Fundin g for this expenditure is to be drawn against Right-of-Way
(ROW) Account 101.3 2 10.5 4 1467-2.
Section 3: The Mayor and the C ity C lerk, as attesting witness, are hereby au thorized
to execute, on behalf of the City, the Renewal Agreement, and/or all o ther customary and necessary
d ocuments to carry out this resolution. The Mayor is additi onally authorized to adm ini strat iv e ly renew
th ese Agree ment s, as provided for by the Ag reeme nts, provided that available funding is a ll ocate d and
approved and that the Co ntractors ho nor the renewal terms. A ll actions taken to date by officer s of the
City in furtherance of the performance of this agreement are hereby approved, confirmed and
ratified .
Section 4: This resoluti on shall become effective w hen approved by majority vote of
the C ity Council and signed by the Mayor or at the next regularly scheduled City Council meeting,
if t he Mayor's signature is withheld or if the City Council overrides the Mayor's veto.
