If the City utilizes state, county, or other governmental agency bids, the competitive bidding will not be required. The affordable housing residents notified the Mayor's office of the increased presence of squatters, illegally parked vehicles, drugs, and crime. Therefore, the Mayor's office, during the holidays, to combat the increased threat to our affordable housing tenants, tasked the Finance management department to find a qualified, cost-effective security guard services contractor to patrol our affordable housing buildings and City Hall. The team found a competitive bid contract and negotiated a discounted rate with the chosen vendor. Security alliance has provided City with excellent service for the last four months. With the presence of security guards and additional steps taken by the administration, the residents are experiencing reduced squatters, illegally parked vehicles, drugs, and crime. We respectfully request that you approve maintaining the services of Security Alliance via a piggyback through Miami Beach RFP 2020-007-JC. Your approval will secure the continuation of three-level V security guards and two vehicles to patrol our affordable housing building and City Hall. Paragraph 4.2 Cost Escalation/Contractor Termination Right of the MB Agreement is hereby deleted in its entirety and the paragraph number shall be reserved to preserve sequence and order in Section 4. Paragraph 4.3 shall be amended to strike "Accounts Payables Division: Payables@miamibeachfl.gov. Invoices shall be submitted to the Contract Administrator at City of Hialeah, Fla. -City Hall; 501 Palm Avenue, 4th Floor; Hialeah, FL 33010. The remaining provisions of Paragraph 4 remain the same and in effect. 7. Paragraph 10.2 Inspector General Audit Rights of the MB Agreement is hereby deleted in its entirety. In its stead, Paragraph 10.2 shall be amended to read: 10.2 Independent Contractor Contractor, its employees, sub-contractors, agents or representatives, shall be deemed to be independent contractors and not agents or employees of the City. The City shall have no obligation to pay or provide for Contractor, Contractor's employees, agents, representatives, or sub-contractors. Contractor, its employees, agents, representatives, or sub-contractors shall not attain any right or benefit under the civil service or pension ordinances of the City, or any right or benefit generally afforded classified or unclassified employees of the City, such as pension benefits, worker's compensation, health insurance, unemployment benefits, or any other right or privilege granted to the City's officers and employees. 8. Paragraph 10.3 Assignment, Transfer or Sub consulting of the MB Agreement is hereby amended to add the following language as the fourth paragraph: Contractor is fully responsible for satisfactory completion of the work by all of Contractor's subcontractors. Subcontracting will not relieve the Contractor of its duties under this Agreement. If any subcontractor fails to perform the part of the work undertaken by it in a satisfactory manner to the City, Contractor shall immediately upon notice from City terminate such subcontractor. Contractor shall have no claim for damages, for 2 compensation in excess of the Compensation agreed to in the respective SOW, or for delay or extension of completions dates within the performance schedule as a result of any such termination. This Agreement is intended for the benefit of the parties hereto and their respective successors and permitted assigns, and is not for the benefit of, nor may any provision hereof be enforced by, any other Person, an is not intended to create any third- party beneficiary rights. 9. Paragraph 10.7(F) is hereby amended to identify the City's Custodian of Public Records and address as: City of Hialeah, Fla.; Marbelys Fatjo, Esq., City Clerk and Records Custodian; City Hall - 3 rd Floor; Hialeah, FL 33010; e-mail: mrubio@hialeahfl.gov; Telephone Number: (305) 883-5820. 10. Section 12 Miscellaneous Provisions of the MB Agreement is amended to add the following language: "12.4 Unauthorized Aliens. Contractor represents that it is registered to use, uses, and shall continue to use the E-Verify system, an internet-based system operated by the United States Department ofHomeland Security that allows participating employers to electronically verify the employment eligibility of newly hired employees, throughout the Term of this Agreement. Contractor also represents that it will require from all subcontractors providing labor, goods or services in connection with this Agreement a sworn statement attesting to subcontractor's registration and use of the E-Verify system, and disclaiming the contracting, employment or hiring of unauthorized aliens consistent with the requirements of§ 4 4 8. 0 9 5 (2)(b) 1. and ( b )2., for the duration of this Agreement. Contractor acknowledges that breach of this provision, by either Contractor or any subcontractor of Contractor, shall result in immediate termination of this Agreement." 13.
